CVM Resolution 598/2018 prohibits offering binary options contracts in Brazil. The CVM continues to enforce it.

The regulatory position

Brazil is simultaneously the single largest source of binary options traffic worldwide and a market where the product is prohibited. The CVM classifies binary options as closer to betting than to securities, and on 13 November 2025 it suspended 24 digital platforms offering crypto, forex, derivatives and binary options without authorisation, under threat of daily fines. Separately, B3 is introducing prediction-style derivatives — structured as binary options on the US dollar, the Ibovespa and bitcoin — but access is restricted to professional investors holding more than R$10 million in financial investments.

Funding and withdrawals in BRL

Deposit rails matter more than payout percentages, because they determine whether money can come back out. Card deposits carry a chargeback route with a time limit; bank transfers to an offshore entity generally do not. Local payment methods routed through a third-party processor add a party that is neither your bank nor your broker, and that party is usually the one that disappears first. Confirm the withdrawal method, minimum, fee and stated processing time in writing before funding an account.

Tax treatment

Profits are generally taxable, with Receita Federal the relevant authority. Whether they are assessed as speculative income or as capital gains depends on how the activity is characterised locally, and that characterisation can change the rate materially. What happens if the broker refuses to pay out?
